‍‍Welcome to WAGERBIRD, a service provided by SkyBurst Technology, Inc. By accessing or using our platform, website, mobile applications, or services (collectively, the “Service”), you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

2. Changes to the Terms of Service

SkyBurst Technology, Inc. reserves the right to modify or update these Terms at any time, and such changes will be effective upon posting to the Service. It is your responsibility to review these Terms regularly. Continued use of the Service following the posting of any changes constitutes your acceptance of those changes.

3. Eligibility

To use WAGERBIRD, you must be at least 18 years old or the legal age of majority in your jurisdiction, whichever is older. By using the Service, you represent and warrant that you meet this eligibility requirement and are capable of forming a binding contract.

4. Description of Service

WAGERBIRD provides access to sports picks, real-time data, predictive models, and other related information (“Picks”) through a pay-as-you-go model. SkyBurst Technology, Inc. does not provide any betting or gambling services. The Service is strictly for informational and entertainment purposes only. Users are responsible for how they use the information provided by WAGERBIRD, and it must not be used in violation of any state, federal, or local laws.

To access certain features of the Service, you will need to register for an account. You agree to provide accurate and complete information during the registration process and to keep this information updated. You are responsible for maintaining the confidentiality of your account credentials, and any activity that occurs under your account is your responsibility. SkyBurst Technology, Inc. reserves the right to terminate or suspend accounts at its discretion.

7. Points and Gems

WAGERBIRD operates on a virtual currency system where users purchase Points or Gems to access premium features, Picks, and simulations. Points and Gems have no monetary value and cannot be redeemed for cash. You acknowledge that SkyBurst Technology, Inc. reserves the right to modify the pricing, usage, or availability of Points and Gems at any time without notice.

8. No Refunds

Due to the digital nature of the Service, all sales of Points, Gems, and other services are final and non-refundable. Once Points or Gems have been purchased and used to unlock Picks or features, no refunds or credits will be issued. Please review your purchases carefully before completing a transaction.

9. WAGERBIRDs and WAGERVISION

WAGERBIRDs are the sports picks generated using proprietary algorithms and data models. WAGERVISION is our live simulation tool that provides real-time game updates. By purchasing WAGERBIRDs or WAGERVISION services, you agree that all content provided is informational and does not guarantee specific outcomes. SkyBurst Technology, Inc. does not assume responsibility for any financial loss resulting from the use of Picks or WAGERVISION data.

10. Payment Terms

All payments for Points, Gems, and other premium services must be made through the payment methods provided on the platform. You agree to pay all fees and applicable taxes associated with your purchase. SkyBurst Technology, Inc. reserves the right to change its pricing structure at any time. All purchases are final, and WAGERBIRD does not offer refunds, except where required by law.

11. Subscription Limits and Availability

WAGERBIRD may impose limits on certain features or services, including WAGERVISION or in-play analytics, due to subscription levels or availability constraints. SkyBurst Technology, Inc. does not guarantee uninterrupted access to its Service and may impose temporary restrictions based on demand.

12. Intellectual Property

‍‍All content provided through the WAGERBIRD platform, including but not limited to Picks, data, algorithms, software, and trademarks, is the property of SkyBurst Technology, Inc. or its licensors. You agree not to copy, reproduce, distribute, or create derivative works based on the Service or any content provided, except as expressly authorized in writing by SkyBurst Technology, Inc.

13. User Conduct

‍‍By using WAGERBIRD, you agree not to: Engage in any unlawful activity, including but not limited to the violation of betting laws. Use the Service for unauthorized commercial purposes. Post, upload, or distribute content that infringes the intellectual property rights of others or is illegal, harmful, or inappropriate. SkyBurst Technology, Inc. reserves the right to suspend or terminate access to any user who violates these rules.

‍‍The Service is provided “as is” without any warranties, express or implied. SkyBurst Technology, Inc. disclaims all warranties, including but not limited to accuracy, completeness, reliability, or fitness for a particular purpose. SkyBurst Technology, Inc. does not guarantee that the Service will be error-free or that access will be uninterrupted.

15. Limitation of Liability

To the fullest extent permitted by law, SkyBurst Technology, Inc., its affiliates, directors, officers, and employees will not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or related to your use of the Service, even if SkyBurst Technology, Inc. has been advised of the possibility of such damages.

‍‍You agree to indemnify and hold SkyBurst Technology, Inc., its affiliates, officers, agents, and employees harmless from any claims, liabilities, damages, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

17. Termination

‍‍SkyBurst Technology, Inc. reserves the right to terminate or suspend your account at any time for any reason, including but not limited to violations of these Terms. Upon termination, your right to access the Service and any content will cease immediately. You will not be entitled to any refunds or compensation.

18. Governing Law, Forum, and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms will be resolved exclusively in the state or federal courts located in Delaware. You agree to submit to the personal jurisdiction of these courts for the purpose of litigating such disputes.

19. Miscellaneous

Entire Agreement: These Terms, along with any additional policies or guidelines provided by SkyBurst Technology, Inc., constitute the entire agreement between you and SkyBurst Technology, Inc. Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Waiver: SkyBurst Technology, Inc.’s failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
